La prestación de servicios sanitarios como relación jurídica de consumo

Abstract

RESUMEN: La presente tesis doctoral aborda el estudio de la prestación de servicios sanitarios desde la óptica del denominado Derecho de Consumo, utilizando las categorías tradicionalmente acuñadas por esta disciplina para analizar la relación clínica y, de este modo, demostrar que el usuario de servicios sanitarios constituye un supuesto de consumidor especial. Por ello, el estudio defiende la aplicación cumulativa y combinada de la legislación sanitaria sectorial y de la normativa general de defensa de los consumidores, criterio hermenéutico que permite el incremento de las técnicas preventivas y reparadoras de las que dispone el paciente. En este sentido, además de los sujetos de la relación prestacional, se estudian como contratos de consumo los títulos de acceso a la asistencia sanitaria, tanto mediante su prestación directa -contrato de servicios médicos y contrato de clínica- como indirecta – contrato de seguro de asistencia sanitaria-. Finalmente otra parte, se analizan los específicos parámetros culpabilísticos aplicables los actos médicos así como la objetivización de la responsabilidad por daños causados por aspectos funcionales del servicio y por medicamentos y productos sanitarios defectuosos.

ABSTRACT: This doctoral thesis deals with the study of the provision of healthcare services from the perspective of so-called consumer law, employing categories traditionally minted by this discipline in order to analyze the clinical relationship and thus demonstrate that the user of healthcare services is a special consumer. Therefore the study advocates the cumulative and combined application of special healthcare legislation and the general rules of consumer law as a hermeneutical criterion for increasing the preventive and remedial techniques available to the patient. In this regard, besides the position of parties in the juridical relationship, the paper analyzes possible agreements for accessing to healthcare as consumer contracts: medical services and hospital services agreements for the direct provision of health services and health insurance for the indirect one. Finally, the paper specially considers specific negligence parameters applied to medical procedures and the non-fault liability system for damages caused by functional aspects of the service and by defective medicines or medical devices.
