Abstract

RESUMEN: Considerado excepcional hace un tiempo, el trabajo nocturno (y el sistema a turnos) se ha convertido en una forma cada vez más habitual de prestar servicios. En este sentido, razones tecnológicas, económicas y sociales justifican que se imponga en más actividades y afecte a un mayor número de trabajadores (sanidad, transporte, comercio, hostelería, limpieza, vigilancia y, por excelencia, a la industria). No obstante, el trabajo nocturno afecta necesariamente a la salud del trabajador, a la conciliación de su vida personal y familiar y a sus relaciones sociales. Por esta razón el legislador prevé unas condiciones laborales especiales (en la jornada y en el salario) para el trabajo prestado en horario nocturno, así como su prohibición a grupos específicos de trabajadores (menores de dieciocho años y trabajadores con contrato para la formación y el aprendizaje). Especialidades que constituyen el objeto de estudio de esta investigación. De esta forma, después de analizar la evolución histórica de la regulación del trabajo nocturno, se delimitan los elementos configuradores del mismo, tomando como punto de partida la diferenciación legal entre trabajo nocturno (que tendrá una retribución específica) y trabajador nocturno (cuya jornada de trabajo presenta una serie de límites cuantitativos). A continuación, tras examinar los elementos que componen la definición legal del trabajo a turnos, se abordan las especialidades del tiempo de trabajo del trabajador nocturno a turnos. Por último, se hace una especial referencia a la compensación del trabajo nocturno. En este sentido, se analizan de forma pormenorizada los distintos problemas aplicativos que ha generado la regulación legal y convencional sobre retribución del trabajo nocturno (naturaleza jurídica, devengo y cuantía del plus de nocturnidad) así como, el régimen de excepciones a dicha retribución cuando se trata de un trabajo nocturno por naturaleza o se ha acordado la compensación del trabajo nocturno por descansos.

ABSTRACT: Regarded in the past as something little frequent, night work and shift work have become nowadays an increasingly frequent way of working. There are economical, technological and social reasons which justify this increase and its spread to a great deal of occupations and workers (health, transport, trade, hotel business, cleaning services, surveillance services and, mainly, industry). However, night work affects necessarily to workers way of life, namely, their health, balance between working and private life and social relationships. Hence, night work has been object of a specific legislation that provides special working conditions (working day and salary) for night shift and its prohibition for some workers (workers under eighteen and workers with training and apprenticeship contracts), subjects that are the object of study of this research. Therefore, after analyzing the historical evolution of night work legal regulation, I shall approach its features bearing in mind the difference between night work with a specific salary and night worker with limited working time. After that, I will revise the legal definition of shift work and its elements to continue with the analysis of the night shift worker’s working hours. I will finish making a special reference to compensation for night work. In this sense, I will offer an insightful analysis of the problems of night work consequence of both legal and conventional regulation (legal nature, accrual and night bonus amount) and the remuneration system exceptions regarding proper night work or night work with compensatory rest.
