RESUMEN: La modernidad es tanto un proceso de conquista de certezas como de producción de incertidumbre. La certeza se afirma como una de las grandes aspiraciones del derecho. En una sociedad como la actual, dominada por la incertidumbre, el derecho tiene que aportar certeza. Lo que hace es transformar incertidumbre. Necesariamente opera con una incertidumbre interna que es constitutiva y está institucionalizada en el mismo Estado de Derecho. Ya no se trata tanto de buscar mejores certezas como de aprender a trabajar con la incertidumbre. El pensamiento jurídico tendrá que plantear sus certezas en función de la incertidumbre.

ABSTRACT: Modernity is not only a process of obtaining certainties but one of producing uncertainties. Certainty is one of the main objectives of the law. In the present society, dominated by uncertainty, law must bring certainty forward. What the law really does is to transform uncertainty. Necessarily operates with an internal uncertainty, which is constitutive and becomes institutional in the democratic State. The question is not so much to find better certainties but to learn how to work with the uncertainty. Legal thinking must propose its certainties depending on uncertainty.
