Abstract

El presente trabajo estudia la regulación de la contratación en los servicios de medicina reproductiva, analizando el marco jurídico de las técnicas de reproducción asistida en España. Se abordan los principales métodos utilizados, el consentimiento informado y las limitaciones contractuales en los acuerdos de donación y crioconservación de gametos y embriones. También se examina la determinación de la filiación en estos casos, incluyendo la fecundación heteróloga y post mortem, así como las restricciones impuestas por la legislación española en materia de gestación subrogada. La jurisprudencia reciente refuerza la nulidad de estos contratos y subraya su incompatibilidad con el orden público. A modo de conclusión, se destaca la importancia de un marco normativo que garantice seguridad jurídica y respete los derechos de todas las partes, aunque los cambios sociales y avances científicos podrían requerir futuras modificaciones legislativas

This paper studies the regulation of contracting in reproductive medicine services, analyzing the legal framework of assisted reproductive techniques in Spain. It deals with the main methods used, informed consent and contractual limitations in gamete and embryo donation and cryopreservation agreements. It also examines the determination of filiation in these cases, including heterologous and post mortem fertilization, as well as the restrictions imposed by Spanish legislation on surrogacy. Recent case law reinforces the nullity of these contracts and underlines their incompatibility with public order. By way of conclusion, it is emphasized the importance of a regulatory framework that guarantees legal certainty and respects the rights of all parties, even though social changes and scientific advances may require future legislative modifications
