RESUMEN: Análisis del significado de la desamortización de los bienes comunales, revisando algunas de las conclusiones que, desde el campo de la Historia del Derecho y del Derecho Administrativo, se han defendido durante décadas, y situando aquella desamortización en la realidad económica y social de la propiedad comunal no sólo a partir de la promulgación de la normativa liberal, sino también con anterioridad, al entender que no basta el simple estudio del Derecho para comprender este proceso.

ABSTRACT: This is an analysis of the significance of the disentailment of communal properties, reviewing some of the conclusions that have been defended for decades from the point of view of History of Law and Administrative Law, situating that disentailment within the social and economic reality of communal property not only as from the enactment of liberal legislation, but also beforehand, as it is clear that a simple study of Law is not enough to fully understand this process.

LABURPENA: Hitzaldi honetan, ondasun komunalen desamortizazioaren esanahiean sakonduko dugu, eta mendetan zehar Zuzenbidearen Historian zein Administrazio Zuzenbidearen Historian defendatu izan diren ondorio batzuk berrikusiko ditugu. Desamortizazioa jabetza komunalaren inguruabar ekonomiko eta sozialean kokatuko dugu, kontuan izanik bai araudi libérala onartu zeneko garaia, eta baita garai zaharragoak ere, prozesu hau behar bezala ulertzeko ez baita nahikoa Zuzenbidera jotzea.
