Abstract

La Sentencia del TEDH de 9 de enero de 2009 (caso Iribarren Pinillos contra España) declara que el Estado demandado ha vulnerado el artículo 3 del Convenio (derecho a no sufrir torturas ni malos tratos) porque el Tribunal Supremo no indemnizó al demandante, herido de gravedad por las fuerzas de policía. La Sentencia de Estrasburgo corrige la interpretación que de los hechos hizo el Tribunal Supremo y deduce del artículo 3 del Convenio un derecho a la indemnización prácticamente autónomo, desligado de una previa declaración de vulneración material o procedimental del precepto y del derecho a un recurso efectivo (art. 13 del Convenio).

The ECHR?s judgement in the case Iribarren Pinillos v. Spain declares that had been a violation of article 3 of the European Convention on Human Rights (prohibition of torture or inhuman or degrading treatment) because the Spanish Supreme Court did not award a dammage compensation to the applicant, who had been severely wounded by the police forces. The Strasbourg judgement deduces from article 3 ECHR a right to be compensated regardless of a previous declaration of violation (material or procedural) of the right ensured by the article 3 and of the right to an effective remedy (art. 13)
