Abstract

This paper addresses the concept of self-employed workers, their legal regulation, and the key differences between self-employed workers and Economically Dependent Self-Employed Workers (TRADE), focusing on some of their main characteristics. Initially, a definition of self-employed workers is presented, and the legal framework regulating them is explored, highlighting their rights and responsibilities within the labor market. Next, the figure of the T is examined, introduced into Spanish legislation by Law 20/2007 and its regulatory development through Royal Decree 197/2009. Fundamental differences between traditional self-employed workers and TRADE are emphasized, including aspects such as economic dependency, subordination, and labor rights and social protections. Finally, one of the main issues associated with TRADE is addressed, with a particular focus on the need to formalize the contract between the TRADE and their client in writing, as well as the legal and practical implications of this requirement. Overall, this paper provides a broad and detailed overview of the situation of self-employed workers and TRADE within the current legal and labor context, highlighting significant differences between both categories and addressing one of the main concerns surrounding TRADE

Este trabajo aborda el concepto de trabajador autónomo, su regulación legal y las diferencias clave entre el trabajador autónomo y el Trabajador Autónomo Dependiente Económicamente (TRADE), centrándose en algunas de sus principales características. Inicialmente, se presenta una definición del trabajador autónomo y se explora la normativa legal que lo regula, destacando sus derechos y responsabilidades en el marco laboral. A continuación, se examina la figura del TRADE, introducida en la legislación española por la Ley 20/2007 y su desarrollo reglamentario mediante el Real Decreto 197/2009. Se destacan las diferencias fundamentales entre el trabajador autónomo tradicional y el TRADE, incluyendo aspectos como la dependencia económica, la subordinación y los derechos laborales y protecciones sociales. Finalmente, se aborda una de las principales problemáticas asociadas a los TRADE, con un enfoque particular en la necesidad de formalizar por escrito el contrato entre el TRADE y su cliente, así como las implicaciones legales y prácticas de esta exigencia
