Abstract

El presente trabajo tiene como objetivo analizar los matrimonios de conveniencia, también conocidos como matrimonios de complacencia o blancos, cuya proliferación en España se ha visto influenciada por el notable aumento de la inmigración. Para abordar esta cuestión, se elaborará un marco teórico del matrimonio como derecho y como institución, detallando los requisitos necesarios para su validez y explorando los beneficios que esta institución jurídica otorga al cónyuge extranjero, como la adquisición acelerada de la nacionalidad, el permiso de residencia y la reagrupación familiar. Seguidamente, se examinarán los matrimonios de conveniencia, desde sus componentes fundamentales y los indicios de su existencia hasta los objetivos que se persiguen y las consecuencias de su detección. Se prestará especial atención a un supuesto real. En resumen, este trabajo ofrece un análisis exhaustivo de los matrimonios de conveniencia, explorando su naturaleza, causas y efectos, así como las estrategias para prevenir y combatir esta práctica en el ámbito jurídico español.

The objective of this work is to analyze marriages of convenience, also known as complacency or white marriages, whose proliferation in Spain has been influenced by the notable increase in immigration. To address this issue, a theoretical framework of marriage as a right and as an institution will be developed, detailing the necessary requirements for its validity and exploring the benefits that this legal institution grants to the foreign spouse, such as the accelerated acquisition of nationality, the residence permit and family reunification. Next, marriages of convenience will be examined, from their fundamental components and the signs of their existence to the objectives pursued and the consequences of their detection. Special attention will be paid to a real case. In summary, this work offers an exhaustive analysis of marriages of convenience, exploring their nature, causes and effects, as well as strategies to prevent and combat this practice in the Spanish legal field.
