Partimos de tres casos que son objeto de estudio, el terrorismo internacional, en concreto la red terrorista Al Qaeda, el conflicto entre Ucrania y Rusia y el conflicto Palestino- Israelí. En estos una de las partes alega el ejercicio de la legitima defensa como causa excluyente de la ilicitud del uso de la fuerza y se analiza si concurre o no. Para ello se estudia el principio de prohibición general del uso de la fuerza, las excepciones admitidas y las que son objeto de debate centrándonos en profundidad en la legitima defensa. Respecto de la legitima defensa partimos de su origen, analizamos sus requisitos y hacemos referencia a aquellos puntos que resultan controvertidos. Con todo esto se responde a si los casos objeto de estudio son lícitos o no a la luz del Derecho Internacional
We start from three cases that are the under study, international terrorism, specifically the Al Qaeda terrorist group, the conflict between Ukraine and Russia and the Palestinian- Israeli conflict. In these, one of the opponents alleges the exercise of self-defense as a reason of exclusion of the illegality of the use of force and it is analyzed whether it occurs or not. To do this, we study the principle of general prohibition of the use of force, the admitted exceptions and those that are the subject of debate, focusing in depth on selfdefense. Regarding self-defense, we start from its origin, analyze its requirements and refer to those points that are controversial. With all this, we answer if the cases under study are legal or not according to International Law
