En nuestro ordenamiento jurídico, el Derecho de Sucesiones se constituye como una rama dentro de Derecho Civil destinada a regular el destino del patrimonio de una persona cuanto esta fallece. Sin embargo, debido a la existencia de las legítimas, la libertad de testar se encuentra limitada, ya que se reserva, por la ley, una porción de bienes para los herederos forzosos. Debido a ello, puede suceder que la persona fallecida realice donaciones en vida para eludir dicha limitación. El objetivo de este trabajo es, por tanto, hacer ver la importancia que tienen las donaciones en este ámbito del derecho, a través del estudio de la figura de la legítima, así como su intangibilidad ,y con ello las acciones de defensa si es perjudicada por cualquier tipo de donación

In our legal system, Inheritance Law is constituted as a branch within Civil Law intended to regulate the destiny of a person's assets when they die. However, due to the existence of legitimates, the freedom to make a will is limited, since a portion of assets are reserved by law for forced heirs. Due to this, it may happen that the deceased person makes donations while alive to avoid this limitation. The objective of this work is, therefore, to show the importance of donations in this área of law, through the study of the figure of the legitimate, as well as its intangibility, and with it the defense actions if it is harmed. for any type of donation
