El despido es una forma de extinción laboral y, en concreto, una decisión unilateral del empresario. Está basado en el principio de causalidad y el juez podrá declararlo improcedente si no se acredita ésta. Este trabajo muestra un análisis de las controversias surgidas alrededor de las consecuencias del despido improcedente que son la indemnización, en función de la antigüedad y el salario o la readmisión del trabajador; en concreto sobre el sistema indemnizatorio español y su posible incompatibilidad con la normativa internacional que, exige, una reparación adecuada en esa búsqueda de la protección del trabajador. Por ello, un sistema tasado podría no ser adecuado, por un tope máximo y la cuantía, pero también por los parámetros que se utilizan para su cómputo. Se analiza la reclamación colectiva que UGT presenta contra España ante el Comité Europeo de Derechos Sociales y que, previsiblemente, condenará a España. Para una completa profundización se estudian los distintos pareceres de los expertos en la materia, que permiten dilucidar, entre otras cosas, los aspectos positivos, como la seguridad jurídica y negativos, como la rigidez, que el sistema puede ofrecer. En este sentido, se muestra cómo los tribunales españoles ya han hecho uso del control de convencionalidad en el cálculo de indemnizaciones donde, por la escasa antigüedad, puede no ser suficiente y han determinado indemnizaciones adicionales a las legalmente tasadas
Dismissal is a form of employment termination and specifically a unilateral decision by the employer. It is based on the principle of causality, and the judge may declare it unfair if this is not proven. This paper presents an analysis of the controversies surrounding the consequences of unfair dismissal, which include compensation based on seniority and salary, or the reinstatement of the worker. Specifically, it examines the Spanish compensation system and its possible incompatibility with international regulations, which require adequate reparation in the pursuit of worker protection. Therefore, a fixed system might not be suitable due to the maximum limits and amounts, as well as the parameters used for its calculation. The collective complaint filed by UGT against Spain to European Committee of Social Rights, which is expected to condemn Spain, is analyzed. To provide a thorough understanding, the opinions of various experts in the field are studied, highlighting both the positive aspects, such as legal certainty, and the negative aspects, such as rigidity, that the system may offer. In this context, it is shown how Spanish courts have already applied conventionality control in the calculation of compensation, where, due to short tenure, it may not be sufficient and have determined additional compensation beyond the legally fixed amounts
