El innegable incremento de la población extranjera ha traído consigo situaciones tales como la perpetuación del denominado “empleo informal”, entendiendo a tal efecto “una situación no regulada del mercado laboral que generalmente incluye acuerdos informales entre empleado y empleador”. Fruto de esta condición es la precariedad laboral propia de quienes desempeñan un trabajo por cuenta ajena careciendo para ello de la correspondiente autorización administrativa. Ello, en tanto en cuanto el temor por verse obligados a regresar a sus países de origen les impide hacer valer los derechos de que son titulares, situación esta (junto con el desconocimiento de tales derechos) de que se vale el empleador en la mayoría de supuestos para gozar de mano de obra barata. En este sentido, nos adentraremos en el reconocimiento de estos derechos así como en la problemática que entraña su ejercicio tanto a nivel legislativo como en el ámbito práctico

The undeniable increase in the foreign population has brought with it situations such as the perpetuation of the so-called "informal employment", understood to this effect "an unregulated labour market situation which generally includes informal agreements between employee and employer". The result of this condition is the precarious nature of the work of persons engaged in paid employment without the corresponding administrative authorization. This, insofar as the fear of being forced to return to their countries of origin prevents them from asserting the rights of which they are holders, this situation (together with the ignorance of such rights) that the employer is using in most cases to enjoy cheap labour. In this sense, we will enter into the recognition of these rights as well as the problems involved in their exercise both at the legislative level and in the practical field
