La STS de 21 de noviembre (Rec. 3576/2020) aborda uno de los debates más vivos en el ámbito de la conciliación laboral y familiar, al tiempo que establece un precedente para futuras decisiones. En concreto, se trata de definir el alcance del derecho a la reducción de jornada por guarda legal y determinar si este derecho implica la posibilidad de aplicar tal reducción al sistema de trabajo a turnos de una trabajadora, de modo que pueda realizar su jornada laboral en un único turno, en contraposición a los turnos alternos de mañana y tarde que realizar. Con este propósito, se debe examinar si la configuración legal de este derecho plantea alguna dificultad interpretativa o, por el contrario, es clara y no genera dudas en relación al derecho y condiciones para su ejercicio.
The Ruling of the Supreme Court of 21 November 2023 (Appeal number 3576/2020) addresses one of the most lively debates in the field of work-family balance, while setting a precedent for future decisions. Specifically, it is a about defining the scope of the right to reduced working hours for legal guardianship and determining whether this right implies the possibility of applying such a reduction to a worker?s shift work system, so that she can work a single shift, as opposed to the alternating morning and afternoon shifts that she used to do. For this purpose, it must be examined whether the legal configuration of this right poses any interpretative difficulties or, on the contrary, is clear and does not raise doubts regarding the right and conditions for its exercise.
