Nowadays, there are many disputes between employers and employees. In order to solve them, they usually have to go to a trial so that a judge can decide in favour of one of the parties. However, there is now an alternative, a special process parallel to the ordinary one, a faster and more agile trial in which the worker can claim an amount of money from the employer, and in a short period of time obtain a right to payment: payment order procedure. In order to better understand how it works, we will study its regulation in the legislation, it’s origin, nature and characteristics, as well as the development of the process and the ways in which it can end depending on the position taken by the employer, with the aim of being able to make a series of deductions and to be able to assess whether it is a success in legislation, or whether, on the contrary, it has a multitude of defects, pointing them out and being able to give a critical opinion that will allow for its correction by the legislator in the future.
Hoy en día existen multitud de conflictos entre empresarios y trabajadores. Para solucionarlos, deben acudir con carácter general a un juicio para que un juez otorgue la razón a una de las partes. Sin embargo, en la actualidad existe una alternativa, un proceso especial y paralelo al ordinario, un juicio más rápido y ágil en el que el trabajador puede reclamar una cantidad de dinero al empresario, y en un reducido plazo de tiempo obtener un derecho de cobro: el proceso monitorio. Para entender mejor cómo funciona, estudiaremos su regulación en la normativa, el origen, naturaleza y características, así como el desarrollo del proceso y las formas que este tiene de finalizar según la posición que tome el empresario, con el objetivo de poder realizar una serie de deducciones y poder valorar si se trata de un acierto en la legislación, o de si por el contrario presenta multitud de defectos, señalándolos y pudiendo otorgar una opinión crítica que permita su corrección por parte del legislador en un futuro.
