Los mecanismos alternativos de resolución de conflictos: la mediación laboral.

Abstract

La mediación se ha presentado a lo largo de la historia como una excelente forma para solucionar los diferentes conflictos que surgían en la sociedad. Hoy en día, se trata de una alternativa al conflicto que cada vez es más empleada. Países como Estados Unidos, llevan décadas utilizando esta vía para solucionar los conflictos, siendo considerado como el origen de la mediación moderna. A raíz de la expansión del uso de los ADR en EEUU, fue la Unión Europa la que quiso copiar este modelo, promoviendo durante años la implantación en los ordenamientos judiciales de los estados miembros. De esta forma, llegaron a España los Sistemas Alternativos de Resolución de Conflictos. Desde hace unas décadas, han sido numerosas los esfuerzos del ejecutivo en introducir los MASC en la legislación española, con el fin de que estos sean una opción de fácil acceso para que sea utilizada por los ciudadanos.
