Abstract

El stealthing, o lo que es lo mismo, la retirada del profiláctico -sin que la otra persona dé su consentimiento- en el trascurso de una relación sexual que si es consentida, ha sido objeto de estudio en este trabajo. Para ello, y como consecuencia de la reforma del Código Penal operada por la Ley Orgánica 10/2022, de 6 de septiembre, de garantía integral de la libertad sexual, hemos tenido que hacer un repaso por la configuración de los delitos contra la libertad sexual antes y después de la misma, para acabar determinado que, tal y como entienden doctrina y jurisprudencia, el Stealthing constituye un delito de agresión sexual -antiguo abuso sexual-. Además de este delito contra la libertad sexual, el stealthing puede tener otras consecuencias jurídicas. Esta práctica puede conllevar un delito de lesiones dolosas, en relación con la transmisión de una ETS a la pareja sexual, y además plantea el problema de los embarazos no deseados, consecuencia de esta práctica. Este último extremo no es contemplado y nos lleva a preguntarnos sobre la ausencia de la perspectiva de género en el ámbito de los delitos contra la libertad sexual.

Stealthing, or what is the same, the withdrawal of prophylactic -without the other person’s consent- in the course of a sexual relationship that if consented, has been the subject of study in this work. To this end, and as a result of the reform of the Criminal Code, which is implemented by Organic Law 10/2022 of 6 September, which guarantees comprehensive sexual freedom, We have had to review the configuration of crimes against sexual freedom before and after it, to finish determined that, as they understand doctrine and jurisprudence, Stealthing constitutes a crime of sexual assault -former sexual abuse. In addition to this offence against sexual freedom, stealthing may have other legal consequences. This practice can lead to a crime of intentional injury, in connection with the transmission of an STD to the sexual partner, and also raises the problem of unwanted pregnancies, a consequence of this practice. This last point is not contemplated and leads us to ask ourselves about the absence of a gender perspective in the area of crimes against sexual freedom.
