La reforma al derecho de sufragio de las personas discapacitadas

Abstract

Tras la entrada en el ordenamiento jurídico español, en mayo de 2006, de la Convención sobre los Derechos de las Personas con Discapacidad (en adelante CDPD o Convención de Nueva York), se produce una tensión entre las exigencias internacionales y las exigencias constitucionales. Y es precisamente cuando el legislador electoral español, como consecuencia de dicha tensión, interpreta las exigencias internacionales, específicamente del Comité que vela por el cumplimiento del CDPD, dando un salto cualitativo al modificar los artículos 3.1 b) y c), y 3.2 de la Ley Orgánica del Régimen Electoral General, y como consecuencia, eliminando la limitación a las personas con discapacidad al momento de ejercer el derecho al voto.
