RESUMEN: En el presente trabajo se van a tratar los conceptos de patria potestad y guarda y custodia, y, en concreto, la figura de la custodia compartida de los hijos menores de edad tras una crisis matrimonial, así como los requisitos tenidos en cuenta para otorgar o no dicho régimen y el funcionamiento del mismo.

ABSTRACT: In this paper, the concepts of parental authority and custody will be discussed and, specifically, the figure of shared custody of minor children after a marital crisis, as well as the requirements taken into account to grant or not that regime and its operation.
