RESUMEN: El concepto de maternidad ha evolucionado y, por ello, la legislación se ha quedado obsoleta. El objeto de este trabajo es la gestación subrogada desde la perspectiva social, jurídica y bioética. Con este trabajo se intentará transmitir la necesidad de una regulación que dé respuesta a los principales problemas de la figura jurídica, poniendo por encima de todo el interés del menor.

ABSTRACT: The concept of “surrogate motherhood” has envolved, resulting in the current legislation’s absolescence. Hence, the subject matter of this paper is “surrogate motherhood from a social, legal and bioethical perspective”. Moneover, the goal of this paper is trying to solve the main problems of the legal figure by a regulation, that prioritizes the minor’s interests.
