Abstract

RESUMEN: El tema de la gestación subrogada en España es jurídicamente incierto y ha provocado importantes conflictos morales, éticos y sociales. En este trabajo se va a tratar la figura de la gestación subrogada como técnica de reproducción humana asistida, desde una perspectiva jurídica. Se analizará la actual normativa española junto con su contradictoria jurisprudencia y su dispar regulación en el derecho comparado. Para ello, se expondrán los pronunciamientos jurisprudenciales que, a lo largo de los años, han ido modificando la prohibición establecida para esta técnica reproductiva recogida en la Ley española 14/2006, sobre técnicas de reproducción humana asistida. Por último, se estudiarán las recientes propuestas legislativas junto con una conclusión actual sobre cómo regular, de la forma más garantista posible, la gestación subrogada en España. ABSTRACT: The issue of surrogacy in Spain is legally uncertain and has provoked important moral, ethical and social conflicts. This paper will deal with surrogacy as an assisted human reproduction technique from a legal perspective. The current Spanish legislation will be analysed together with its contradictory jurisprudence and its disparate regulation in comparative law. To this end, the jurisprudential pronouncements that, over the years, have modified the prohibition established for this reproductive technique in Spanish Law 14/2006, on assisted human reproduction techniques, will be presented. Finally, recent legislative proposals will be studied, together with a current conclusion on how to regulate surrogacy in Spain in the most protective way possible.
