Abstract

RESUMEN. La imposibilidad de prescribir la propiedad pública de los bienes comunales de las entidades locales, declarada ya en Las Partidas pero ignorada por el Código Civil (que los consideró patrimoniales o de propiedad privada de tales entidades), deriva de su afectación al aprovechamiento común por los vecinos, aprovechamiento concebido como una servidumbre personal discontinua, traducida en un derecho real administrativo de goce sobre fincas propiedad de la entidad local de residencia -que no de los vecinos, como ocurrió históricamente en un principio, en cuyo caso nos hallaríamos ante una comunidad de uso y disfrute-, lo que impide la adquisición por prescripción de la propiedad pública de tales bienes mientras no sean desafectados de dicho aprovechamiento común, imposibilidad de prescripción que -aun antes de la calificación de dichos bienes como de dominio público por la Constitución de 1978- constituyó un refuerzo de la propiedad forestal pública frente a las usurpaciones, pues la mayoría de los montes públicos españoles pertenecen a las entidades locales, siendo en gran parte de aprovechamiento común.

ABSTRACT. The inability to prescribe public ownership of the commons of local au-thorities, already declared in Las Partidas but ignored by the Civil Code (which the considered property or private property of such entities), derived from their involvement in common use by neighbors, use conceived as a personal servitude discontinuous, translated into a real right of enjoyment on farms administrative ownership of the local authority of residence -not the neighbors, as happened historically in the beginning, in which case we would be facing a community use and enjoyment-, which prevents the acquisition by prescription of public ownership of such goods until they are no longer used in such common use, inability prescription -even before qualifying for such goods as public domain by the Constitution of 1978 -was a strengthening of the public forest estate to encroachments, as most Spanish public forests belong to local authorities, still largely used in common.
