ABSTRACT. The historical significance of migratory flows has traditionally encouraged the United Nations system, and in a very intense manner the ILO concerning labour ones, to on countless occasions regulate them. Thus, a regulatory set is erected, the understanding of which is complex. This complexity is due to the possible partiality of the ratifications, the eventual by the states of the ratified texts or the practicability of a non-complete territorial application thereof. Among these reasons, the lack of a unique definition of what the migrant worker is must be expressly underlined. The interpretation of this reality is also difficult because the substantive regulation of migrant workers does not lie in the ILO?s migratory standards themselves, the purpose of which should be primarily to guarantee the effectiveness of other regulations. This reflection is therefore proposed to reveal the real dimension of this normative framework and to unravel the keys to facilitate its most correct understanding, outstandingly the different legal treatment of regular and irregular migrant workers, including some intermediate situations. Uncovering the evolution of this legal standards, the reflection leads to a series of proposals to improve the protection of migrant workers.

RESUMEN. La trascendencia de los flujos migratorios explica que el sistema de Naciones Unidas, y en particular la OIT en los laborales, se haya afanado reiteradamente en disciplinarlos. Se erige así un conjunto normativo cuya lectura es compleja, tanto por la posible parcialidad de las ratificaciones, su eventual modificación de los textos ratificados o la practicable aplicación territorial no íntegra de los mismos. Por citar algunas de las causas que dificultan esta tarea y que incluyen una falta de definición común del trabajador migrante regulado. Una interpretación cuya dificultad se acrecienta por la necesidad de comprender que la normativa sustantiva de este colectivo no radica en los instrumentos migratorios de la OIT, cuyo fin habría de ser primordialmente garantista de la eficacia de otras normas respecto de dichos sujetos. Esta reflexión se propone desvelar la real entidad de este entramado normativo al tiempo que desentrañar las claves para su más correcta comprensión, entre las que sobresale el diverso tratamiento legal de trabajadores migrantes regulares e irregulares, pasando por situaciones intermedias. Desvelando la evolución habida, la reflexión desemboca en una serie de propuestas necesarias para encauzar jurídicamente su tutela.
