Abstract

RESUMEN: Con el presente trabajo, se pretende, en primer lugar, ofrecer una visión global de la Victimología, como disciplina científica, analizando su origen, evolución, concepto, así como su método y su relación con otras ciencias sociales y jurídicas. La Victimología es aquella disciplina que tiene por objeto el estudio de la víctima de delitos. Por ello, además del estudio de la Victimología, se intenta ofrecer, en segundo lugar, una aproximación al concepto de víctima de delito y a los derechos que la legislación española le otorga, siendo el principal punto de referencia del análisis la Ley 4/2015, de 27 de abril, del Estatuto de la víctima del delito. Por último, ha sido interesante estudiar una determinada tipología de víctimas, como las que son objeto de los delitos de robo y hurto. En concreto, interesaba analizar si en Cantabria los Tribunales adoptan medidas de protección hacia este tipo de víctimas. Tras un examen de las sentencias de los últimos años, se ha podido comprobar que, con carácter general, las medidas de protección se adoptan en algunos delitos de robo, sobre todo cuando la víctima ha sido objeto de conductas violentas o intimidatorias.

ABSTRACT: The present work aims to offer a global vision of Victimology as a scientific discipline, analyzing its origin, evolution, concept, as well its method and its relationship with other social and legal sciences. Victimology is the discipline that has as object the study of the crimes victim. For this reason, in addition to the study of Victimology, we try to offer, in second place, an approach to the concept of the crime victim and to the rights that Spanish legislation grants him/her, being the main point of reference of the analysis the Law 4/2015, of April 27, of the Statute of the crime victim. Finally, it has been interesting to study a certain typology of victims, such as those who are subject to the crimes of robbery and theft. Specifically, it was interesting to analyze if the Courts in Cantabria adopt protection measures towards this type of victims. A review of the sentences of recent years has shown that, in general, protective measures are taken in some robbery crimes, especially when the victim has been subjected to violent or intimidating behavior.
