Patentes farmacéuticas y su relación con los acuerdos ADPIC

Abstract

RESUMEN: La ley de patentes en el campo de las drogas siempre ha sido un tema controvertido. En este proyecto de fin de grado, analizamos la ley de patentes en España, cómo se desarrolla, los requisitos para obtener la patente, el certificado de protección complementario que solo se usa en Europa y el sistema de patentes de Europa. Todo este contenido está en la primera parte del Proyecto. La segunda parte estudia los acuerdos ADPIC relacionados con la ley de patentes y cómo estos acuerdos afectan los medicamentos para los países en desarrollo. U puede ver una amplia explicación sobre la declaración de Doha, su desarrollo posterior y las consecuencias que esto produjo. Los países en desarrollo enfrentan algunos problemas serios debido a sus circunstancias económicas, demográficas o sociales. Los acuerdos ADPIC tratan de resolver estos problemas relacionados con las drogas, pero si verificamos la ley buscando una solución efectiva, encontramos que el término legal actual no se utiliza debido a la falta de consideración sobre los factores que impiden que los países en desarrollo utilizando este mecanismo.

ABSTRACT: Patent law in the field of drugs has always been a controversial issue. In this final degree project , we analise the patent law in Spain, how it is develop, the requirements to get the patent, the supplementary protection certificate which is only used in Europe, and the Europe patent system. All of this content it´s on the first part of the Project. The second part studies about the TRIPS agreements related to the patent law, and how this agreements affect onto the drugs for developing countries. U can see a wide explanation about Doha statement, its posterior development, and the consequences that came about that. The developing countries are confronting some serious issues due to their economical, demographical or social circumstances. The TRIPS agreement try to solve this issues related to the drugs, but if we check the law searching for a effective solution, we found that the current legal term is not used due to the lack of consideration about the factors that prevent the developing countries from using this mechanism.
