RESUMEN: Al ser la maternidad subrogada un método ilegal en nuestro país, los nacionales que pretenden acceder a ella tienen que desplazarse a países en los que está permitida, encontrándose, a su retorno, con numerosos problemas jurídicos. Dichos problemas aparecen cuando pretenden acceder a dos fines: la inscripción en el Registro Civil del recién nacido y el acceso a la prestación por nacimiento y cuidado de menor. Por ello, ambas situaciones serán tratadas y desarrolladas en el presente trabajo.
ABSTRACT: As surrogate motherhood is an illegal method in our country, nationals who want to access it have to travel to countries where it is allowed, being, on their return, with numerous legal problems. These problems appear when they intend to have access to two ends: registration in the Civil Registry of the newborn and access to birth and child care protection. Therefore, both situations will be treated and developed in the present work.
