ABSTRACT: This work aims to analyze the recent phenomenon related to marriage of convenience, very much ingrained from a social point of view, going through all the respective phases of the common marriage as we know, which are the civil and religious ones; since both spouses know each other and give their consent until they go to the Civil Registration for the effective inscription. This public entity, thanks to their employees and their instructions, tries to control and look out all the marriages that are inscribed, in order to avoid the illegal ones, which are likely to be the simulated marriages. Finally, we also take an approach to what our jurisprudence says about it.
RESUMEN: Este trabajo pretende analizar el creciente fenómeno de los matrimonios de conveniencia, muy arraigados desde un punto de vista social, pasando por todas las fases del matrimonio tal y como lo conocemos, esto es, bien en forma civil o religiosa; y desde que ambos cónyuges se conocen y prestan su consentimiento hasta que acuden al Registro Civil para su posterior inscripción. Éste, mediante sus encargados y las instrucciones dictadas por la Dirección General de Registros y Notariado, trata de controlar y vigilar que no se produzca ningún matrimonio simulado. Por último, analizamos también la jurisprudencia que aborda este tema.
