RESUMEN: El presente trabajo nace con el objeto de analizar al accidente acaecido al ir o volver del lugar de trabajo o más conocido como accidente in itinere. Con una perspectiva histórica de su configuración originaria contrastada con la evolución de los pronunciamientos de los tribunales, los cuales han guiado esta figura jurídica en una dirección fuertemente ligada a la propia evolución de la realidad sociolaboral en la cual se enmarca. Ésta manifiesta dependencia de los tribunales para circunscribir el ámbito legal del accidente in itinere ha devenido en un vasto conjunto de sentencias que han determinado la propia naturaleza de esta figura jurídica y al mismo tiempo han instituido los requisitos determinantes de esta, lo que es analizado en este trabajo, en relación con una interpretación de estos criterios cada vez más finalista llegando a producirse un verdadero desbordamiento del concepto de accidente de trabajo en un afán de protección y en correlación a la naturaleza protectora del sistema de seguridad social.

ABSTRACT: Present academic work was born in order to analyse the accident occurred on the journey, known as work accident “in itinere”. From a historical perspective of its original configuration in contrast with the pronouncement evolution of courts through which have led this legal figure to a strongly linked direction to the own evolution of the social and labour reality in which is delimited. This manifest situation of dependence of courts to determine the legal framework has result in a great number of sentences which have defined the nature of this legal figure and as the same time it has introduced its determining requirements, all of that is analysed in the present academic work, in relation with an interpretation purpose-oriented as the sentences are pronounced, as a result the concept of work accident “in itinere” has been spread going further than the strict concept with the intention of protection in interrelationship with the protective nature of social security system.
