Abstract

RESUMEN: Nuestro trabajo se basa en el estudio del sistema establecido por la Carta Social Europea (CSE), que a pesar de su importancia en el ámbito de la protección de los derechos económicos y sociales en Europa, esto no sólo sigue siendo muy desconocido, sino que además España todavía no se ha incorporado de manera plena al mismo. Además nos hemos encargado de determinar las características generales del sistema CSE y de hacer un examen comparativo con el Convenio Europeo de Derechos Humanos (CEDH) para su mejor entendimiento se ha examinado la manera en que España se ha incorporado a este sistema y las consecuencias prácticas que esa incorporación ha supuesto, tanto por los avances que se han producido en nuestra legislación por la pertenencia de España a la CSE, como en términos de no conformidad. Sobre la base de este examen no hemos apreciado obstáculos importantes a la incorporación de España al Protocolo Adicional de 1995 sobre las reclamaciones colectivas ni a la CSE revisada, más allá de los meramente políticos, pero si consideramos su necesidad y convenienca, y ello sin perjuicio de que hemos observado, que tanto el Protocolo de 1995 como la CSE revisada parecen poseer una cierta presencia en nuestro ordenamiento, aunque sea de manera indirecta.

ABSTRACT: Our work is based on the study of the system established by the European Social Charter (CSE), which despite its importance in the field of the protection of economic and social rights in Europe, this not only remains very unknown, but also Spain has not yet been fully incorporated into it. We have also been in charge of determining the general characteristics of the CSE system and of making a comparative examination with the European Convention of Human Rights (ECHR). To better understand it, we have examined the way in which Spain has incorporated this system and the practical consequences that this incorporation has meant, both because of the advances that have taken place in our legislation due to Spain's membership in the CSE, and in terms of non-conformity. On the basis of this review, we have not seen any significant obstacles to the incorporation of Spain to the Additional Protocol of 1995 on collective claims or to the revised CSE, beyond the merely political ones, but if we consider their necessity and convenience, and without prejudice We have observed that both the 1995 Protocol and the revised CSE seem to have a certain presence in our order, albeit indirectly.
