RESUMEN: Con este trabajo se pretende analizar los conflictos planteados a causa de la obtención de patentes basadas, en todo, o en parte, en el conocimiento acumulado por uno o varios grupos humanos sin mediar reconocimiento, remuneración o traprestación. Las empresas farmacéuticas, cosméticas y la industria agroalimentaria han sido las más interesadas en patentar este patrimonio natural y cultural que habría de reconocerse y protegerse como tal.

ABSTRACT: The aim of this work is to analyze the conflicts caused due to obtaining patents based -in whole or in part- in the knowledge accumulation by one or more human groups without any recognition, remuneration or reward. Pharmaceutical, cosmetic and food industry companies have been the most interested in patenting this natural and cultural heritage that should be recognized and protected as such.
