RESUMEN: En este trabajo se analiza la figura de la maternidad subrogada desde un punto de vista jurídico. La regulación legal de esta técnica de reproducción asistida es un tema controvertido y para comprender mejor este fenómeno se analiza tanto la legislación y jurisprudencia españolas como legislaciones foráneas y algunos casos de gran relevancia sobre los que se ha pronunciado el Tribunal Europeo de Derechos Humanos.

ABSTRACT: In this paper surrogacy motherhood in analyzed from a legal point of view. The legal regulation of this technique of assisted reproduction is a controversial subject and to better understand this phenomenon we analyze both Spanish legislation and jurisprudence as foreign legislation and some cases of great relevance on which the European Court of Human Rights has ruled.
