Abstract

RESUMEN: En el presente trabajo me propongo analizar los avances que el estudio de los delitos de Lesa Humanidad ha producido en el campo de la autoría en Derecho Penal. Para ello, comenzaré estudiando brevemente la estructura típica que presenta este tipo de delitos en el Código Penal Español y en el Estatuto de Roma de la Corte Penal Internacional. Una vez solventado esto, expondré los concretos problemas que han aparecido en la aplicación de cada forma de autoría y participación en la comisión de delitos de Lesa Humanidad. Para ello, me serviré de la distinción, enunciada por ROXIN, entre delitos de dominio y delitos de infracción de deber y descenderé hasta las clásicas formas de intervención punible: autor directo, autor mediato, coautor y partícipe.

ABSTRACT: In this following research, I will analyze the development the theory of perpetration in the Concept of Crime derived from the Crimes Against Humanity . For this propose, I will start making a summary of the actus reus of these types of crimes like they are represent in the Spanish Criminal Law and in the Rome Statute of the International Criminal Court. After exposing this part, I will expose the concrete problems that have appear in the commission of the Crimes Against Humanity. It is because of these, that I will use the distinction named by ROXIN, I will analyze among the dominion crimes and the breach of duty crimes and then the classic forms of perpetration: author, indirect author, co-author and complicity.
