Abstract

RESUMEN: El accidente de trabajo en misión es una creación jurisdiccional que hasta la fecha no ha sido regulada por el legislador. Esto ha supuesto una variación en lo que se refiere a los criterios a aplicar para considerar si un accidente laboral merece o no tal calificación y, por extensión, en las sentencias dictadas por el TS. La conexión entre el trabajo y el desplazamiento y la presunción de laboralidad son dos pilares para dilucidar si se ha producido un accidente in itinere, en misión o si el hecho ocurrido ni siquiera debe calificarse como accidente laboral. En este sentido, la jurisprudencia comenzó teniendo una visión amplia de lo que es un accidente de trabajo en misión; paulatinamente esta visión se ha ido restringiendo. El presente Trabajo de Fin de Grado pretende analizar las variaciones en torno a esta figura tan controvertida y en ocasiones confundida con el accidente in itinere. Para ello se han tenido en cuenta tanto la doctrina científica como la jurisprudencia dictada por el Tribunal Supremo en los últimos años.

ABSTRACT: The work accident on mission is a jurisdictional creation that, to date, has not been standardized by the legislature. This means a variation regarding the criteria to be applied to consider whether or not an occupational accident deserves such qualification and, by extension, in the judgments issued. The connection between work and displacement and the presumption of work are two pillars for determining if there has been an accident in itinere, on mission or if the event that occurred should not even be classified as an occupational accident. In this sense, the Jurisprudence began having a broad vision of what is a work accident in mission; gradually this vision has been restricted. The present dissertation aims to analyze the variations around this controversial issue, sometimes confused with the accident in itinere. To this end, both doctrine and jurisprudence have been taken by Supreme Court in recent years
