La crisis de la seguridad social en materia de salud como servicio público esencial a cargo del estado: causal de una falla en prestación del servicio en Colombia

Abstract

La Constitución Política en su artículo 49 enuncia y califica la salud en Colombia como un servicio público en cabeza del Estado, el cual de acuerdo a dicho texto constitucional debe ser prestado y garantizado a todos los colombianos bajo los principios de “eficiencia, universalidad y solidaridad”. Para cumplir con dicho deber la Carta Magna en el inciso tercero del artículo mencionado, permite que entidades del sector privado brinden este servicio bajo la figura de la delegación y la descentralización, haciendo la claridad de que la prestación del servicio de salud debe estar bajo la supervisión de las autoridades que el Gobierno Colombiano asigne para ello. A pesar de existir tal responsabilidad en cabeza del Estado, la situación del sistema de seguridad social en salud en Colombia, es caracterizada por constantes deficiencias en el servicio, así como falta de cobertura, calidad y oportunidad en los mismos, constituyéndose una de las principales causas de dichas falencias, la crisis que en la actualidad adolece el sistema de seguridad social en salud. Así las cosas, y bajo la premisa de que es responsabilidad del Estado el garantizar la prestación del servicio, en la presente disertación se plantea como problema de investigación, determinar si la crisis del sistema de seguridad social

The Political Constitution in its article 49 states and qualifies health in Colombia as a public service headed by the State, which according to said constitutional text must be provided and guaranteed to all Colombians under the principles of "efficiency, universality and solidarity ". In order to comply with this duty, the Magna Carta in the third paragraph of the aforementioned article allows private sector entities to provide this service under the figure of delegation and decentralization, making it clear that the provision of the health service must be under the Supervision of the authorities assigned by the Colombian Government. Despite the fact that there is such a responsibility at the head of the State, the situation of the social security system in Colombia is characterized by constant deficiencies in the service, as well as lack of coverage, quality and timeliness, constituting one of the main Causes of these shortcomings, the crisis that currently suffers the system of social security in health. Thus, under the premise that it is the responsibility of the State to guarantee the provision of the service, in the present dissertation it is posed as a research problem, to determine if the crisis of the social security system
