Abstract

Esta tesis aborda un análisis exhaustivo del régimen de responsabilidad del empleador frente al COVID-19, enfocado particularmente en los trabajadores del sector salud, quienes fueron los más expuestos y afectados por la pandemia. La investigación revela cómo, a pesar de la naturaleza fortuita e inesperada de la emergencia sanitaria, las instituciones públicas y privadas en Colombia no actuaron con la diligencia requerida para proteger a sus empleados. El estudio se centra en la responsabilidad subjetiva del empleador, estableciendo que la normativa colombiana exige la creación de condiciones seguras para el desempeño de cualquier actividad laboral. Sin embargo, durante la pandemia, muchos empleadores fallaron en proporcionar los elementos de protección necesarios, lo que resultó en daños significativos a la salud física y mental de los trabajadores, incluso en la muerte de algunos de ellos. La tesis también examina jurisprudencia relevante de la Corte Constitucional y la Corte Suprema de Justicia, que refuerza la obligación del empleador de actuar con el cuidado y la previsión necesarios para evitar perjuicios a sus trabajadores. A través de entrevistas con personal sanitario y un análisis de estadísticas del Ministerio de Salud, se expone cómo el COVID-19 exacerbó la vulnerabilidad de estos trabajadores, dejando en evidencia una grave omisión por parte de los empleadores. Finalmente, el trabajo resalta la falta de sentencias condenatorias en Colombia por culpa patronal en el contexto de la pandemia, lo que subraya la necesidad de una mayor protección y reconocimiento de los derechos de los trabajadores en situaciones de emergencia sanitaria.

This thesis presents a comprehensive analysis of employer liability in the context of COVID-19, with a particular focus on healthcare workers, who were the most exposed and affected by the pandemic. The research reveals how, despite the fortuitous and unexpected nature of the health emergency, public and private institutions in Colombia did not act with the required diligence to protect their employees. The study centers on the subjective liability of the employer, establishing that Colombian regulations require the creation of safe conditions for the performance of any work activity. However, during the pandemic, many employers failed to provide the necessary protective equipment, resulting in significant damage to the physical and mental health of workers, even leading to the death of some. The thesis also examines relevant case law from the Constitutional Court and the Supreme Court of Justice, which reinforces the employer's obligation to act with the necessary care and foresight to prevent harm to their workers. Through interviews with healthcare personnel and an analysis of statistics from the Ministry of Health, it is shown how COVID-19 exacerbated the vulnerability of these workers, revealing a serious omission on the part of employers. Finally, the study highlights the lack of condemnatory rulings in Colombia for employer negligence in the context of the pandemic, emphasizing the need for greater protection and recognition of workers' rights in health emergency situations.
