The rules provided for in the preliminary title of the General Code of Procedure are governing rules that radiate the entire procedural statute, so, in case of tension or conflict with the other provisions of the same, the provisions of the preliminary title will prevail, as has been demonstrated. when studying the different sentences on topics such as: dynamic burden of proof, interrogation of the party itself, precautionary measures in declaratory processes, early sentencing and the automatic loss of jurisdiction.
Las normas previstas en el título preliminar del Código General del Proceso son normas rectoras que irradian todo el estatuto procesal, por lo que, en caso de tensión o conflicto con las demás disposiciones del mismo, prevalecerán las disposiciones del título preliminar, así como quedo demostrado al estudiar las diferentes sentencias en temas como: carga dinámica de la prueba, interrogatorio a la propia parte, medidas cautelares en procesos declarativos, sentencia anticipada y pérdida automática de competencia.
