La finalidad del proceso disciplinario está dirigida a hacer prevalecer la justicia, garantizar la efectividad del derecho sustantivo, buscar la verdad material y cumplir los derechos y garantías debidos a las personas que en él intervienen. Con base en este postulado, el decisor disciplinario, desde los principios de presunción de inocencia especial y particularmente, debido proceso con sus elementos integradores y legalidad, tiene la obligación de investigar con igual rigor los hechos y circunstancias que demuestren la existencia de falta disciplinaria y la responsabilidad del investigado y los que tiendan a demostrar su inexistencia o lo eximan de responsabilidad. Desde esta perspectiva, el presente documento, resultado de una investigación analítica, da preeminencia al principio pro homine, pues el respeto por la dignidad humana y la búsqueda de la verdad material, son prueba fehaciente de la materialización del Estado Social de Derecho.

The purpose of the disciplinary process is aimed at ensuring justice prevails, guaranteeing the effectiveness of substantive law, seeking material truth and fulfilling the rights and guarantees owed to the people involved in it. Based on this postulate, the disciplinary decision-maker, from the principles of presumption of innocence and particularly, due process with its integrating elements and legality, has the obligation to investigate with equal rigor the facts and circumstances that demonstrate the existence of disciplinary misconduct and the responsibility of the investigated and those that tend to demonstrate its non-existence or exempt him from responsibility. From this perspective, this document, the result of an analytical investigation, gives preeminence to the pro homine principle since respect for human dignity and the search for material truth are reliable proof of the materialization of the Social State of Law.
