Abstract

Esta investigación tiene como propósito dar a conocer los antecedentes históricos y el desarrollo del uso de las llamadas “minas antipersonales” y artefactos explosivos improvisados, en el territorio colombiano en particular por parte de las organizaciones terroristas que delinquen en el país, y la forma como las autoridades nacionales e internacionales han tratado mediante convenios, tratados, leyes y acciones de mitigar sus efectos nocivos, de una parte identificando a las víctimas y de otra buscando la eliminación de su uso y la implementación de medidas efectivas de desminado de las zonas afectadas, además la responsabilidad del Estado por estos hechos. Para los efectos anteriores, se ha de realizar un recuento histórico de la utilización de las minas y de artefactos explosivos, tomando como base la doctrina sobre el particular, para posteriormente analizar el marco fáctico colombiano y la lucha contra esta situación que agrava el panorama de seguridad nacional. Lo anterior, sumado a que la situación de las víctimas del conflicto armado en Colombia, es más compleja y difícil de superar debido a la falta de reparación y las condiciones indignas a las que se ven expuestos, pues además de una desprotección total y de falta de garantías que resguarden sus derechos, están sometidas a todo tipo de vejámenes y contextos de desplazamientos forzados, masacres y vulneración de sus derechos humanos, pese a la suscripción del Acuerdo de Paz, pues regiones como el Chocó, Nariño, Putumayo, entre otros, sugieren la presencia de grupos al margen de la ley que hace.

The purpose of this research is to present the historical background and development of the use of the so-called "antipersonnel mines" and improvised explosive devices, in Colombian territory in particular by terrorist organizations that commit crimes in the country, and the way in which National and international authorities have tried through conventions, treaties, laws and actions to mitigate its harmful effects, on the one hand by identifying the victims and on the other by seeking the elimination of its use and the implementation of effective demining measures in the affected areas. also the responsibility of the State for these events. For the above purposes, a historical account of the use of mines and explosive devices must be made, based on the doctrine on the matter, to subsequently analyze the Colombian factual framework and the fight against this situation that aggravates the panorama of National security.
