El objetivo principal de la propuesta de trabajo de grado de nivel maestría es analizar los elementos con que cuentan las organizaciones sindicales del sector público en el ámbito nacional y establecer cuáles son los mecanismos jurídicos para materializar de las conquistas sindicales de los empleados públicos a través de la negociación colectiva. En aplicación de la investigación jurídica doctrinal, mediante el método analítico, se deduce la existencia de beneficios normativos en el ámbito interno para los representantes de las entidades públicas y para los dirigentes sindicales de los empleados públicos; no obstante lo anterior, se observa que la normatividad vigente es exigua, y que nuestra legislación colombiana requiere fructificar la tendencia actual de reglamentación de los convenios internacionales para consagrar expresamente las facultades para negociar los representantes sindicales del sector público con las diferentes entidades gubernamentales.
The main objective of the master's degree work proposal is to analyze the elements available to trade union organizations in the public sector at the national level and establish what are the legal mechanisms to materialize the union conquests of public employees through collective bargaining. In application of the doctrinal legal investigation, through the analytical method, the existence of normative benefits in the internal sphere for the representatives of public entities and for the union leaders of public employees is deduced; Notwithstanding the foregoing, it is observed that the current regulations are meager, and that our Colombian legislation requires the fruition of the current trend of regulation of international agreements to expressly consecrate the powers to negotiate public sector union representatives with the different government entities.
