Abstract

El presente documento, contiene el desarrollo de las premisas fundamentales que permiten sostener que la consecuencia procesal correcta frente a la omisión absoluta de los hechos jurídicamente relevantes al interior del proceso penal en virtud de los postulados del garantismo penal como criterios de corrección en el estado social de derecho es la absolución. Esto por cuanto se enmarca en el desarrollo de una tesis de maestría investigativa que pretende poner en duda y criticar constructivamente las instituciones procesales existentes, contribuyendo de esta forma con la estructuración coherente del sistema jurídico colombiano. Para esto, en primer lugar se describirán conforme al estado actual, la definición de los Hechos Jurídicamente Relevantes en el proceso penal colombiana, para lo cual consecuentemente se hace necesario delimitar la estructura del delito aplicada en Colombia. Luego, se analizarán los errores en los cuales puede incurrir la Fiscalía al estructurar los Hechos Jurídicamente Relevantes y las soluciones procesales que la Corte Suprema de Justicia les ha dado, para así, luego, plantear el Garantismo como criterio de corrección de las instituciones jurídicas en el orden constitucional colombiano, según el cual es posible evaluar cada una de las consecuencias procesales identificadas, determinando en consecuencia, que la correcta es la absolución del procesado. This document contains the development of the fundamental premises that allow sustaining that the correct procedural consequence in the face of the absolute omission of the legally relevant facts within the criminal process by virtue of the postulates of criminal guaranty as criteria of correction in the social state of law is the acquittal. This is because it is framed in the development of a research master's thesis that aims to question and constructively criticize the existing procedural institutions, thus contributing to the coherent structuring of the Colombian legal system. 5 For this, in the first place, the definition of the Legally Relevant Facts in the Colombian criminal process will be described according to the current state, for which it is consequently necessary to delimit the structure of the crime applied in Colombia. Then, the errors in which the Prosecutor's Office may incur when structuring the Legally Relevant Facts and the procedural solutions that the Supreme Court of Justice has given to them will be analyzed, in order to then propose the Garantism as a criterion of correction of the legal institutions in the Colombian constitutional order, according to which it is possible to evaluate each of the procedural consequences identified, determining, consequently, that the correct one is the acquittal of the defendant.
