Mediante la presente tesis se profundiza la importancia del principio de buena fe objetiva en la contratación estatal, por medio de la jurisprudencia se demuestra la falta de aplicabilidad de este precepto por parte de los proponentes y/o contratistas del estado y se recomiendan mecanismos efectivos para motivar a los colaboradores del estado a participar activamente en la estructuración de los procesos de selección, particularmente en la licitación pública para minimizar riesgos en beneficio de la comunidad.
Through this thesis, the importance of the principle of objective good faith in state contracting is deepened, through jurisprudence the lack of applicability of this precept is demonstrated by proponents and/or state contractors and effective mechanisms are recommended to Motivate state collaborators to actively participate in the structuring of selection processes, particularly in public bidding to minimize risks for the benefit of the community.
