Abstract

In the first part, this research provides a broad overview of the national and international normative, jurisprudential, and doctrinal framework in relation to the issue of the right to defense of persons deprived of liberty and the concept of special relationships of subjection. Secondly, the analysis of many disciplinary proceedings that have been brought against persons deprived of liberty in three national prisons is presented. Therefore, the evidence found in relation to substantive and procedural aspects is observed. Finally, the result of this research is presented concretely based on the findings, presenting an academic proposal of legal rank.
