Se realiza un análisis crítico y sistemático sobre la figura jurídica de la insolvencia en persona natural no comerciante, tanto desde su génesis y configuración legislativa actual en Colombia, como de las respectivas implicaciones que tiene el proyecto de Ley de insolvencia tanto en deudores como acreedores, a fin de establecer cuál podría ser el impacto para las partes, respecto de la nueva propuesta que se encuentra en trámite en el Congreso de Colombia. Así mismo se trata de abordar y conocer, cuáles serán los derechos y garantías que tendrán los deudores y acreedores cuando sea presentada esa figura en aquellas circunstancias en las cuales el deudor, por diversas circunstancias o situaciones, se ve abocado a una crisis económica que le impide atender sus obligaciones respectivas y, por lo tanto, requiere renegociar las deudas, llegar a acuerdos con los acreedores y, si es necesario, liquidar el patrimonio. Estos elementos aquí señalados son fundamentales porque inciden notablemente en las condiciones de vida que tendrá que afrontar el deudor, pero a su vez, generaría inseguridad jurídica en los acreedores, en cuanto a si existen verdaderas expectativas de recuperar los bienes recursos invertidos. Lo anterior, como quiera que, en el entorno actual, se viene adelantando o abordando con mayor regularidad el tema de la insolvencia, bien sea la empresarial o en persona natural no comerciante; contribuyendo a una visión más holística sobre las relaciones jurídicas entre deudores y acreedores y las posibilidades para llegar a acuerdos justos que permitan superar las crisis económicas, máxime porque a más de un año de iniciarse el fenómeno sanitario -COVID-19, es evidente que se requieren de nuevas reglas que impulsen la economía, pero también, que logren canalizar suficientes garantías y derechos a las partes para que puedan salir de la profunda crisis en que tiene esta enfermedad al mundo en general.
