Trata de personas en el Derecho Penal

Abstract

Human trafficking has been gaining a deeper impact, not only as an economical factor that is considered a highly lucrative crime business that is right behind drugs and arms trade. But also, to the vulnerability of human rights to those who are exposed to such situation, particularly women and children. Contemporary slavery or human trafficking is a process that involves illegal exploitation to people, this occurs from one country to another or within a country itself which happens for the most part in developing nations, however, there is no exception to the rest of the world. It also takes place between cities and even amongst nearby neighborhoods. The most common ways of human trafficking are labor and sexual exploitation. Although, almost always there is violence, distortion and constrain on behalf of the offender(s), many times the victim chooses to leave his own country, these offenders are usually involved in organized criminal networks. As a conclusion, it is important to come up with adequate judicializing methods not only for punishment but to avoid the perpetuation of the human trafficking crime. El tema de la trata de personas se ha venido convirtiendo en uno de los flagelos delictivos de mayor importancia tanto, por su connotación económica, al ser considerado como un delito altamente lucrativo después de las drogas y la venta de armas, como por su, vulneración a los derechos humanos de los sujetos sobre los que recae su actuación principalmente mujeres y niñas(os). Se concibe la trata o tráfico de personas, como un proceso de explotación ilegal, que se realiza de un país a otro, o al interior de los países, regularmente, pero no exclusivamente del tercer mundo, inclusive al interior de las mismas ciudades y barrios. “Las formas recurrentes de esta modalidad de delito son el tráfico de mano de obra, el destinado a la prostitución o explotación sexual de la víctima. Aunque en ocasiones es la propia víctima quien decide emigrar, la coacción, violencia o engaño siempre está presente en este delito, normalmente perpetrado por redes criminales organizadas” Dada la problemática descrita, resulta importante plantear mecanismos de judicialización adecuados que a futuro no solo castiguen, sino que además prevengan la prolongación de este delito.
