La criminalización de la protesta como expresión del derecho penal del enemigo en Colombia

Abstract

Frente a la constante tensión entre la protesta social como derecho y la criminalización de la misma bajo el argumento de la seguridad nacional, me veo avocada a analizar críticamente la criminalización de la protesta social, como una propuesta fundamentada en la teoría dogmática denominada derecho penal del enemigo, desarrollada de manera independiente por Jakobs y Cancio y por Zaffaroni, para luego confrontarlas con la teoría garantista que desarrolla Luigi Ferrajoli, dentro de un Estado social y democrático de derechos de corte garantista como lo es el Estado colombiano. La finalidad es dejar claro que la protesta social en Colombia debe ser pensada siempre dentro del escenario de derecho fundamental, y no bajo la posibilidad de un tipo penal.

Faced with the constant tension between social protest as a right and the criminalization of it under the argument of national security, I am committed to critically analyzing the criminalization of social protest, as a proposal based on the dogmatic theory called criminal law of enemy, developed independently by Jakobs and Cancio and by Zaffaroni, to then confront them with the guarantee theory developed by Luigi Ferrajoli, within a social and democratic state of rights of a guaranteed nature, such as the Colombian State. The purpose is to make it clear that social protest in Colombia must always be considered within the framework of fundamental law, and not under the possibility of a criminal offense.
