El ejercicio de la herramienta de la extensión de jurisprudencia del Consejo de Estado en la Sección Segunda

Abstract

Las presentes líneas tienen como propósito mostrar a los lectores el resultado del estudio de casos en los cuales se ha aplicado la figura de “extensión de la jurisprudencia de unificación del Consejo de Estado”, haciendo especial énfasis en aquellos que fueron resueltos por la Sección Segunda de dicha Corporación. Ejercicio con el cual se logró advertir que la solicitud de extensión de los efectos de jurisprudencias de unificación emanadas por el Consejo de Estado que han presentado los ciudadanos ante las autoridades administrativas no ha sido eficaz como se esperaba, pues, en el tiempo que lleva en aplicación el mecanismo no se ha conocido ni un solo caso en que haya prosperado su utilización ante dichas autoridades. Sin embargo, la Sección Segunda del Consejo de Estado ha marcado la pauta y en sede judicial sí ha accedido a extender los efectos de sus sentencias de unificación según lo dispone el artículo 269 de la Ley 1437 de 2011.

The purpose of these lines is to show readers the result of the study of cases in which the figure of "extension of the jurisprudence of unification of the Council of State" has been applied, with special emphasis on those that were resolved by the Second Section of said Corporation. Exercise with which it was possible to notice that the request for extension of the effects of unification jurisprudence issued by the Council of State that citizens have presented before the administrative authorities has not been effective as expected, therefore, in the time that the mechanism has been in application, not a single case has been known in which its use before said authorities has prospered. However, the Second Section of the Council of State has set the tone and in court has agreed to extend the effects of its unification sentences as provided in article 269 of Law 1437 of 2011.
