Abstract

La administración pública, es un constructo institucional que tiene diversos objetivos de orden constitucional. Damos por sentado que las instituciones deben propender por la satisfacción del bien común, y coadyuvar a la solución de las necesidades básicas y la garantía de los derechos de los administrados, y demás cometidos del Estado. Pero en ocasiones pasa inadvertida una realidad que permite abordar el asunto de la institucionalidad desde otra óptica. Las instituciones, son ficciones jurídicas, que a la postre se componen de personas. Son ciudadanos, quienes, investidos del poder estatal, procuran sus cometidos. El concepto de empleados públicos, servidores públicos, burocracia, y en general, de aquellas personas que trabajan con el Estado, son denominaciones que conciernen a diversas especies que merecen una clasificación más concreta, a fin de distinguir tanto sus derechos como sus responsabilidades. Con el presente estudio, nos proponemos establecer cuáles son las deficiencias en que incurre la gobernación de Boyacá, en sede judicial, que conllevan a que el Tribunal Administrativo de Boyacá y el Tribunal superior de Tunja emitan de forma reiterada condenas relacionadas con el pago de emolumentos laborales, del personal vinculado mediante contratos de prestación de servicios.

Public administration is an institutional construct that has various constitutional objectives. We take it for granted that the institutions must strive for the satisfaction of the common good, and contribute to the solution of basic needs and the guarantee of the rights of the administered, and other tasks of the State. But sometimes a reality goes unnoticed that allows us to address the issue of institutionality from another perspective. institutions, they are legal fictions, which in the end are made up of people. They are citizens who, invested with state power, pursue their tasks. The concept of public employees, public servants, bureaucracy, and in general, of those people who work with the State, are denominations that concern various species that deserve a more specific classification, in order to distinguish both their rights and their responsibilities. With this study, we intend to establish what are the deficiencies incurred by the government of Boyacá, in court, which lead to the Administrative Court of Boyacá and the Superior Court of Tunja repeatedly issuing sentences related to the payment of emoluments. labor, of the personnel linked by contracts for the provision of services.
