Origen constitucional del principio de la ilicitud sustancial

Abstract

El derecho disciplinario en Colombia ha tenido en su trasegar la dura tarea de construirse como una rama autónoma respecto de las demás que hacen parte del ius puniendi estatal. Nuestra tradición disciplinaria bebe de las aguas del derecho alemán y español en lo que tiene que ver con la forma como esos dos regímenes estatales han afrontado la tarea de corregir a sus disciplinados de una forma particular. Dentro de aquel recorrido se ha buscado tener unos conceptos dogmáticos propios y exclusivos del derecho disciplinario, que logren esa diferenciación a la que arriba aludimos y que precisamente sirvan para estructurarlo en la teoría y en la práctica.
