Abstract

La teoría general de la prueba judicial ha entendido la valoración probatoria de los enunciados empíricos como un ejercicio epistemológico regulado por la forma jurídica de la dogmática, propia de la ciencia procesal penal o teoría general del proceso penal que desemboca en el paradigma racional de la prueba judicial a través de la sana crítica. Lo problemas que surgen en el campo de la argumentación de estos enunciados, devienen en complejidades y contradicciones entre la noción de verdad y los derechos de las partes en el proceso, reflejando un modelo de racionalización sistémico de la sociedad contemporánea. La tarea trazada, es reconstruir el proceso judicial en clave de la teoría de argumentación habermasiana con miras a una búsqueda cooperativa de la verdad que garantice la racionalidad en lo que tiene que ver con los enunciados fácticos. Para llegar a ello, se abordará la noción de verdad desarrollada por Habermas en el curso de tres de sus obras; a saber: Teoría de la Acción Comunicativa, Facticidad y Validez y Verdad y Justificación. Luego, su crítica a la modernidad desde su teoría social y de argumentación judicial y, por último, la deducción de los postulados sobre su teoría del discurso a la justificación de los enunciados fácticos en el proceso judicial.

The general theory of judicial evidence has understood the evidentiary evaluation of empirical statements as an epistemological exercise regulated by the legal form of dogmatics, of the criminal procedure science or general theory of criminal procedure that leads to the rational paradigm of judicial evidence through sound criticism. The problems that arise in the field of the argumentation of these statements become complexities and contradictions between the notion of truth and the rights of the parties in the process, reflecting a model of systemic rationalization of contemporary society. The task outlined is to reconstruct the judicial process in key of the theory of Habermasian argumentation with a view to a cooperative search for truth that guarantees rationality in what has to do with factual statements. To achieve this, the notion of truth developed by Habermas in the course of three of his works will be addressed: Theory of Communicative Action, Facticity and Validity and Truth and Justification. Then, his critique of modernity from his social theory and judicial argumentation and, finally, the deduction of the postulates on his theory of discourse to the justification of factual statements in the judicial process.
