Abstract

El proyecto hidroeléctrico Hidroituango en Colombia es tema de debate permanente desde el año 2014. El presente trabajo de investigación conocerá acerca de los actos administrativos, comunicados y providencias judiciales, los cuales obran como fundamento de la declaración de la responsabilidad del Estado por hechos antijurídicos, conforme a los antecedentes históricos que surgieron con el avance de dicho proyecto, donde se involucran fuentes primarias y secundarias con enfoque metodológico cualitativo1, descriptivo y socio jurídico a partir de la licencia ambiental otorgada por Ministerio de Ambiente al proyecto Hidroituango, que dio paso al inicio de la construcción de este proyecto, que en su inicio tenía la viabilidad de construir dos túneles, que debían ser compuertas de desviación, que servían como escape para el agua del Río Cauca, mientras se llevaba a cabo la elaboración de la presa.

The Hidroituango hydroelectric project in Colombia has been the subject of ongoing debate since 2014. This research work will learn about the administrative acts, communiqués and judicial decisions, which serve as the basis for the declaration of the State's liability for antijuridical facts, according to the historical background that arose with the progress of the project, involving primary and secondary sources with a qualitative methodological approach, The environmental license granted by the Ministry of Environment to the Hidroituango project, which gave way to the beginning of the construction of this project, which at the beginning had the feasibility of building two tunnels, which were to be detour gates, which served as an escape for the water of the Cauca River, while the elaboration of the dam was being carried out.
