Flexiguridad como solución ante dificultades de protección a la estabilidad laboral

Abstract

La Flexiguridad ha sido propuesta como la respuesta adecuada a las dificultades de garantizar el derecho fundamental a la estabilidad laboral en nuestro contemporáneo mundo de libre mercado. Este trabajo de investigación se propone estudiar y analizar, en el marco de las obligaciones generadas en normas supranacionales, el bloque de constitucionalidad y la legislación colombiana, a partir de la garantía al derecho fundamental a la estabilidad laboral, las variables de protección que ofrece la figura de la Flexiguridad en un escenario influenciado por la economía de mercado internacional, creando o fortaleciendo instituciones de protección social, al empleo y al trabajador, instituciones de diálogo y negociación laboral, en la búsqueda de un verdadero, justo y equitativo equilibrio social entre el derecho al empleo y la flexibilidad laboral contractual.

The flexicurity has been proposed as the adequate answer to the difficulties of guaranteeing the fundamental right to labor stability in our contemporary world of free market. This investigation proposes to study and analyze, in the frame of supranational norms, the Colombian constitutional block and legislation, in terms of its guarantee to the fundamental right of labor stability, the protection variables that the flexicurity frame offers, in a scenario influenced by the international market, creating or enforcing institutions involved in social protections, employment and the worker, institutions of dialogue and negotiation, in the search of a true, just, and fair social equilibrium between the right to an employment and the flexibility of labor contracts
